The Fairbanks Morse marine diesel engines in question were fully compliant with all air emission requirements. The Department of Justice's complaint concerns only a minor issue regarding labeling of the engines, and the amounts sought to resolve the complaint would not be material to EnPro's results or to the results of its Fairbanks Morse Engine business. However, EnPro and Fairbanks Morse strongly disagree with the position taken by the Department and Coltec and Fairbanks Morse intend to vigorously defend themselves in the matter.
