(NYSE: NPO) issued the following statement today regarding the resolution of allegations by the U.S. Department of Justice (DOJ) and the Environmental Protection Agency (EPA) that EnPro’s Coltec Industries subsidiary violated the Clean Air Act (CAA) and the EPA’s marine diesel engine air rules:
We are pleased to have resolved voluntarily these issues with the DOJ and the EPA. The outcome will enable Fairbanks Morse Engine (FME), which has been widely recognized for its environmental stewardship, to upgrade emissions controls at the Beloit, Wisconsin facility where the engines in question were manufactured. The allegations by the DOJ and EPA involved engines manufactured by FME that complied with EPA emissions requirements; the allegations dealt only with correctly following the certification and labeling requirements for those engines. The FME equipment that will be upgraded as part of this settlement is in full compliance with the air emissions requirements of both the EPA and the Wisconsin Department of Natural Resources and was not the subject of the allegations. However, as part of the resolution of this matter with the DOJ and EPA, FME voluntarily proposed the installation of state-of-the-art emission controls on the equipment, which includes a test stand and exhaust stack used to test engines manufactured for U.S. Navy ships.
