The U.S. Small Business Administration has issued the results of its periodic review of Approved Class Waivers from the Nonmanufacturer Rule.
SBA posted a notice in the Federal Register on March 26, 2009, and on April 22, 2009 in the FedBizOpps.
The purpose of the notice was to determine if there were any small business manufacturers or processors for the products listed on the list of approved class waivers.
SBA received five responses from small business concerns; reviewing them, the SBA determined there are presently no small business manufacturing sources for any of the products on its list as of March 17, 2009.
The basis for a waiver is, "no small business manufacturers are supplying these classes of products to the Federal Government."
In order to be considered "available" to participate in the Federal marketplace for a class of products, a small business manufacturer must have submitted a proposal for a contract solicitation or received a contract from the Federal government within the last 24 months.
A waiver is important because it allows any other qualified small businesses to supply products sourced from any manufacturer to satisfy a Federal contract set aside for a small businesses, a service-disabled veteran-owned small businesses, or participants in SBA's 8(a) Business Development Program.
The list of approved class waivers for these products will remain in effect until qualifying small business manufacturing is discovered.
