India has been part of the revocation of a patent granted to Roche Holding AG breast cancer drugs, the Swiss company said on Sunday, in the latest regulatory setbacks, Western pharmaceutical companies trying to crack the fast-growing market.
Roche spokesman said the company consider taking further course of action to be taken.
Kolkata Patent Office said Monday that the company failed to submit correct patent applications and patents of Herceptin has not been revoked.
Roche refused to comment on this statement.
Herceptin is Roche's third-largest sellers and registered in the first half of the global income 3.08 CHF billion. It is to produce a protein called tumor HER-2, which may make them more aggressive disease in breast cancer patients.
Intellectual property and pricing decisions, for some foreign pharmaceutical companies sell drugs in India has frustrated attempts.
